condizioni di vendita all’incanto 1. L’aggiudicazione avviene al terzo appello a favore del maggior offerente contro pagamento immediato in valuta svizzera. Non è ammesso il pagamento dilazionato. Tutte le fatture devono essere pagate entro e non oltre 7 giorni dalla vendita. Dopo questa data, la somma dovuta e le relative spese saranno richieste per via legale. Pagamenti ritardati saranno sottomessi a degli interessi di dila zione dell’ 1% per ogni mese iniziato. 2. L’acquirente è personalmente responsabile delle proprie offerte e non può obiettare di aver agito per conto di terzi. La casa Germann ha il diritto di chiedere agli offerenti ad essa sconosciuti la prova della loro identità prima che inoltrino le loro offerte. 3. Al prezzo di aggiudicazione viene aggiunto un supplemento corrispettivo per diritto d’asta, calcolato come segue: Per un prezzo di aggiudicazione fino a CHF 200 000.–: 19% Per un prezzo di aggiudicazione oltre i CHF 200 000.–: 19% sui primi CHF 200 000.– 14% sulla differenza da CHF 200 000.– fino al prezzo di aggiudicazione Sulla provvigione, I’acquirente deve pagare la TVA Svizzera. Sui lotti indicati con il segno*, viene aggiunta la TVA Svizzera, calcolata sulla provvigione e sul prezzo di aggiudicazione. Se viene presentata una dichiarazione d’esportazione debitamente bollata dalla dogana svizzera per i lotti indi - cati con il segno *, la casa d’asta rimborsa la TVA ai commercianti all’estero, se questa supera CHF 50.–. 4. Tutti gli oggetti in questione vengono venduti all’asta per conto e nel nome di terzi. 5. L’acquirente deve accettare gli oggetti nello stato in cui si trovano al momento dell’aggiudicazione. Durante l’esposizione gli acquirenti possono esaminare attentamente gli oggetti. La descrizione degli oggetti avviene secondo scienza e coscienza; la casa Germann non si assume tuttavia responsabilità alcuna circa le indicazioni riportate sul catalogo. Si declina espressamente ogni responsabilità per danni materiali o giuridici, salvo quanto riportato al § 6. 6. a) Se dovesse risultare che l’oggetto acquistato è un fal so intenzionale e non corrisponde alle indicazioni del catalogo, la casa Germann annulla la vendita e rimborsa il prezzo d’acquisto qualora l’oggetto venga restituito entro un anno dall’aggiudicazione e nelle stesse condizioni in cui si trovava al momento del- I’acquisto. b) E’ falsificazione intenzionale ogni contraffazione che induce in inganno l’acquirente sull’origine, la data l’epoca e la provenienza dell’oggetto, non descritta come tale nel catalogo, e al momento dell’aggiudicazione di valore nettamente inferiore a quello riportato nel catalogo. c) Valgono tuttavia le sequenti limitazioni: il diritto di restituzione è inammissibile: conditions of sale by auction 1. After an export declaration duly signed by the Swiss cus - toms authorities has been received for the lots marked with *, the auctioneer will refund the Swiss VAT to foreign buyers, provided that the sum exceeds CHF 50.–. 4. All objects are put up for auction on behalf and on account of third parties. 5. The buyer must take possession of the objects in the condition in which they are today, that is at the time of being knocked down to him. During the preview the objects are open to inspection. They are described to the best of Germanns knowledge and belief, but the auctioneer cannot be held respon sible for the data given in the catalogue. Guarantee for defects of any kind, both physical and legal, is excluded explicitly, except for the provisions made in paragraph 6. 6. a) If, within one year from the date of acquisition of an ob ject, the buyer informs the auctioneer in writing that the said object is a wilful imitation and returns the same in the conditions in which it was knocked down to him, and in fact it turns out to be a wilful imitation with respect to its description in the catalogue, the auctioneer will cancel the sale. b) The proof of wilful imitation is to be supplied by the buyer. Any copy which was produced with intent to deceive either with respect to its maker, origin, date, epoch, cultural area or source, without this appearing from the text of the catalogue, and which was worth less at the sale than it would have been if the object had matched its description, is considered a wilful imitation. c) The following restrictions shall apply, however the object can not be returned: – if the description in the catalogue was made in keeping with the level of research or according to the opinion of the majority of experts at the time when the catalogue was being compiled; or – if in keeping with the level of research, the imitation was not to be qualified as such at the time when the cata logue was being compiled.

L’acquirente entra in possesso dell’oggetto dopo il pagamento totale del prezzo di aggiudicazione e del supplemento. Ad aggiudicazione avvenuta, la responsabilità civile per perdita, furto, deterioramento e distruzione dell’oggetto acquisito passa all’aggiudicatario. 8. La casa Germann si riserva la facoltà di rifiutare un’offerta senza indicarne i motivi. 9. La casa Germann si riserva il diritto di raggruppare alcuni oggetti elencati sul catalogo o di separarli, di offrirli secondo un ordine diverso o di tralasciarli completamente. 10. Ogni offerta costituisce un impegno d’acquisto esigibile. L’offerente rimane vincolato alla sua offerta fino al momento in cui essa è superata o rifiutata dalla casa. In caso di offerte doppie, I’oggetto viene immediatemente rimesso all’asta. In caso di dubbio deciderà il rappresentante municipale di Zurigo. 11. Generalmente le offerte partono da un prezzo inferiore a quello di riserva stabilita dal venditore. Le opere d’arte possono essere aggiudicate senza essere state vendute, senza che ciò sia riconoscibile prima della fine della vendita. 12. Gli oggetti acquistati devono essere ritirati, a spese e rischio dell’acquirente, entro 10 giorni dalla vendita. La ca sa Germann accetta, su richiesta, ordini di spedizione degli oggetti acquistati, ma declina tutta responsabilità di sopraddetta azione. 13. L’aggiudicatario che si attiene alle condizioni qui enumerate, sarà tenuto al risarcimento. L’indennizzo include anche la perdita, dovuta ad un ricavo inferiore raggiunto in un’asta successiva, come pure le commissioni e le spese per ambedue le vendite. Acconti versati dall’aggiudicatario possono essere compensati col risarcimento del danno. Valgono inoltre le disposizioni legislative del codice delle obbligazioni art. 213 ss. e 102 ss. Nel caso che l’oggetto passi in possesso dell’aggiudicatario prima del pagamento completo, la casa Germann o il venditore possono recedere dal contratto e rivendicare l’oggetto. 14. Le condizioni di cui sopra sono parte integrante di ogni singolo contratto di vendita stipulato all’asta. Cambiamenti sono validi solo per iscritto. 15. Lo stato e il Comune di Zurigo sono esonerati da ogni responsabilità giuridica. Il funzionario designato dal Comune agisce solo in funzione di sorvegliante e senza alcuna responsabilità giuridica. Per ogni controversia che dovesse insorgere tra le parti sarà applicato il diritto svizzero. Luogo d’adempimento e foro giuridico è Zurigo 7. Riservato il ricorso al Tribunale federale. In caso di contestazione fa stato il testo in lingua tedesca. d) The object can only be returned by the buyer, on whose name the invoice is issued. 7. Once the object has been knocked down, the buyer is liable for loss, theft, damage or destruction thereof. 8. The auctioneer may refuse a bid without explanations. 9. For the purpose of auctioning, the auctioneer may group objects listed in the catalogue under different numbers, or separate objects listed under the same number, call them out of sequence or omit them altogether. 10. A bid constitutes a firm offer to buy. The bidder remains bound by it until either a higher price is offered or the auctioneer refuses it. The relationship between the par - ties to the contract is governed by Swiss law in all respects. Deliveries are due at Zurich 7 which is also the place of jurisdiction. The right of recourse to the Swiss Federal Court is reserved. The original text in German is binding. 11. As a rule, bids are invited below the reserve price. Works of art may be knocked down without having been sold, without this becoming apparent prior to the end of the auction. 12. The objects acquired must be picked up at the close of the auction or within ten days thereafter on risk and costs of the buyer. On demand, Germann assists with organizing the transport, but declines all liability resulting of said act. 13. A buyer who does not abide by the conditions outlined above, is liable to pay damages. These may include a loss incurred by auctioning off the object a second time as well as the buyers premium and expenses due for both sales. Down-payments by the buyer may be offset against the claim for damages. In addition, articles 213 and following and 102 and following of the Swiss Code of Obligations shall apply.
